2. The petitioner seeks regular bail in connection with Pakriwarama (Dhamaul O.P.) P.S. Case No. 486 of 2022 registered for the offence under Sections 363 366(A), 376(C), 370(A) of the Indian Penal Code.

3. As per the prosecution case, a minor girl was kidnapped by the accused persons, and she was sent to Rajasthan where she was sold to the co-accused for marriage.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and is in custody since 29.01.2024.

5. Learned A.P.P. has vehemently opposed the prayer for bail and has submitted that the victim in her statement

Patna High Court CR. MISC. No.33969 of 2024(3) dt.13-09-2024 2/2 recorded under Section 164 of the Cr.P.C. has said that it is the petitioner who had taken her to Putul Devi @ Sunita Devi @ Mira Devi who sent the victim to Kota with one Dilip Kumar.

6. Considering the facts and circumstances and also considering the role of the petitioner in the crime, I am not inclined to grant bail to the petitioner.

7. Accordingly, this application for regular bail is dismissed. The court below is directed to expedite the trial of the petitioner.

8. The Superintendent of Police, Nawada is directed to produce the witness(s) in the trial.

9. Let a copy of this order be communicated to the Superintendent of Police, Nawada through FAX for its compliance forthwith.
