The petitioner seeks pre-arrest bail in connection with Kotwali (Adampur) P.S. Case No. 438/14 registered under Sections 420 and 468/34 of the Indian Penal Code. It has been contended that similarly circumstanced co-accused Raju Mandal has already been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 30th June, 2015 passed in Cr. Misc. No. 1701/15. It is further contended that save and except oral allegation made in the FIR, there is no documentary evidence to support the allegation.

No.53989 of 2015 (2) dt.08-12-2015 2 / 2 Regard being had to nature of allegation and other attending facts and circumstances of the case, in the event of arrest or surrender in the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Adampur) P.S.
