The petitioners seek bail in anticipation of their arrest in connection with Pupri P.S. Case No. 124 of 2017 dated 14.05.2017 instituted for the offences under Sections 147, 149, 341, 342, 353, 323, 224, 225 and 504 of the Indian Penal Code.

The petitioners are alleged to have prevented the police party from effecting the arrest of one Ramesh Rai, who was an accused in connection with Pupri P.S. Case No. 77 of 2017. As far as the allegation in the FIR stands, though the petitioners have been named in the FIR for having created disturbance in the execution of the official work of police viz. the arrest of an accused

Patna High Court Cr.Misc. No.15808 of 2018(2) dt.06-04-2018 2/2 person of another case but, the manner in which they have obstructed the police party or the information which led the informant to name them in the FIR, does not appear to be clear.

The petitioners do not have any criminal antecedent.

The other offences in the FIR are bailable except for Section 353 of the Indian Penal Code. Thus, the petitioners above named, are directed to be released in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Pupri, Sitamarhi in connection with Pupri P.S. Case No. 124 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
