JUSTICE RAKESH KUMAR ORAL ORDER 13-07-2017 Heard Sri Praveen Kumar Agrawal, learned counsel for the petitioner. None appeared on behalf of the State. The petitioner, apprehending his arrest in Madhepura P.S. Case No. 109 of 2017 , registered for offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016 has prayed for grant of bail in the event of arrest or surrender. It was submitted by learned counsel for the petitioner that nothing was recovered either from conscious possession of the petitioner or from his house , but recovery of 5 1⁄2 liter Indian make foreign liquor was shown from a latrine, which was not of the petitioner and thereafter, two accused persons were arrested who disclosed as if the petitioner was supplying the liquor to them. Considering the nature of accusation and material against the petitioner, in the event of arrest or surrender within a period of six weeks from today, let the petitioner Prince Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura / concerned court in connection with Madhepura P.S.
