The petitioner apprehends his arrest in Patliputra P.S. Case No. 171/2016, registered for the offences punishable under Sections 406, 420 and 34 of the Indian Penal Code. The informant alleged that Deepak Prasad took Rs. 2,50,000/- for registration of a deed of agreement to sell 03 Kattha 15 Dhurs of land situated in Plot no. 84, Patliputra Colony. It is alleged that Deepak Prasad received Rs. 7,50,000/- in cash before executing the deed of agreement to sell in favour of the informant, but thereafter Deepak Prasad did not execute the sale deed on one pretext or other. The informant further alleged that he requested the broker Nitesh Shahi and Arvind Kumar Singh (petitioner) to

Learned counsel for the petitioner submits that the petitioner has no manner of concern with the informant and the complainant. He is not even witness to the deed of agreement to sell. The petitioner did not receive any money from the informant. Considering the facts aforesaid and the fact that petitioner neither received any money from him to get the sale deed executed in his favour nor any role is assigned to the petitioner, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Patna in connection with Patliputra P.S. Case No. 171/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
