The petitioner seeks pre-arrest bail in connection with Complaint Case No. 214/2010/T.R. No. 3762/14 registered under Sections 302, 201 and 120-B of the Indian Penal Code. It is contended that similarly circumstanced coaccused Surendra Singh and Ramjiwan Singh have been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 24.11.2015 passed in Cr. Misc. No. 53553 of 2015, whereas another co-accused Dilip Kumar Singh has been granted anticipatory bail vide order dated 10.11.2015 passed in Cr. Misc. No. 52722 of 2015. The contention of the petitioner is
Patna High Court Cr.Misc. No.53485 of 2015 (2) dt.07-12-2015 2 / 2 that the complainant of the present case is himself being prosecuted for the murder of his mother and the accusation against him was found to be true during police investigation. The petitioner being a witness in police case instituted against the complainant has been implicated in the present false case after 11 years of the alleged occurrence.
Regard being had to the facts and circumstances of the case and the reasons assigned in the aforesaid orders passed by different Benches of this Court, in the event of arrest or surrender in the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Darbhanga in connection with Complaint Case No. 214/2010/ T.R. No. 3762/14 subject to the conditions as laid down under Section 438(2) Cr. P.C.
