2. The petitioner apprehends his arrest in connection with Dalsingh Sarai P.S. Case No. 285 of 2023, registered for the offences punishable under Sections 313, 406, 420, 498(A) of the IPC and Sections 3/4 of the D.P. Act.

3. As per allegation, the marriage of daughter of the informant was solemnized with the petitioner in the year 2018. The customary presents were given to the petitioner according to affording capacity of the informant. By deceitful means, the petitioner got a gift deed of the residential house from the informant in his favour.

Learned Senior counsel for the petitioner has submitted that on the ground of desertion and cruelty, the petitioner has filed a suit for decree of divorce which was transferred from Calcutta to Samastipur, Bihar on the order of the Hon'ble Supreme Court. He has further submitted that the petitioner is presently paying Rs. 5,000/- per month to his wife, to which he assures to continue.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-I, Dalsingh Sarai at Samastipur in connection with Dalsingh Sarai P.S. Case No. 285 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C.

6. The petitioner shall pay Rs. 6,000/- per month to his wife (opposite party no. 2), which shall be set off from the amount of maintenance if subsequently granted to the victim, by any competent court.
