The petitioners are apprehending arrest in a case registered under Sections 272, 273 of the Indian Penal Code and Section 30a of the Bihar Prohibition and Excise Act, 2016. The prosecution case, in short, is that when a hutment was searched by the police, some raw liquor as well as apparatus used for preparing liquor were recovered. One of the fleeing accused persons was apprehended at the spot who named these petitioners as his associates.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent and nothing incriminating has been recovered from their possession.

No.26802 of 2019(4) dt.17-07-2019 2/2 Considering the aforesaid facts and circumstances, let both the petitioners, above named, in the event of arrest/surrender before the learned court below it within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Motihari, East Champaran in Ramgarhwa Police Station Case No. 297 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
