The sole prayer made on behalf of the petitioner as gathered from the submissions by learned senior counsel for the petitioner who has strongly relied upon a decision by the apex court in the case of Anil Kumar Vitthal Shete Vs. State of Maharashtra, AIR 2006 SC 2018 is that the learned court below be directed to proceed independently and fearlessly with the proceeding of the suit. No other submission has been made on behalf of the petitioner.
Patna High Court CWJC No.16113 of 2013 dt.04-02-2017 After considering the submission on behalf of the petitioner to which the learned counsel for the State-respondent has also not raised any objection, this Court however does not find any material reflecting upon the conduct of the proceeding in the learned court below. It needs no repetition that every court has been enjoined to act fearlessly and independently.
The application sans merit is accordingly dismissed.
