JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-04-2018 The petitioner seeks bail in anticipation of his arrest in connection with Kako P.S. Case No. 17 of 2018, dated 21.01.2018, instituted for the offences punishable under Sections 341, 323, 504, 506, 307, 379 and 34 of the Indian Penal Code.
The petitioner and others are said to have assaulted the informant and looted her properties. No reason has been assigned in the First Information Report for the cause of occurrence.
Learned counsel for the petitioner has submitted
Patna High Court Cr.Misc. No.15785 of 2018 (2) dt.05-04-2018 2/3 that because of the pending land dispute between the parties, such false case has been lodged in which the petitioner and others have been made accused. It has further been submitted that the wife of one of the coaccused persons of this case, viz. Bindeshwar Das has also lodged a First Information Report against the informant of the present case vide Jehanabad SC/ST P.S. Case No. case No. 05 of 2018, dated 21.02.2018. It has been submitted that the petitioner is a teacher and on the date of occurrence, as alleged in the First Information Report, he was on duty in Tarari Block in the district of Bhojpur at Ara.
Regard being had to the fact that no reason has been assigned in the First Information Report for the cause of occurrence and there does not appear to be any injury on the informant, this Court is inclined to grant anticipatory bail to the petitioner.
For the reasons stated aforestated, let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-IV-Cum-Additional Chief
