20-05-2015 Sri Jai Krishna Prasad, learned counsel, who appears on behalf of Respondent no.7, in presence of Sri Bhola Prasad, learned counsel for the petitioners as well as learned AC to GP-3, intends to file counter affidavit. It may be filed in the Registry. The present writ petition pertains to a dispute under the provisions of Section 48(D) of the Bihar Tenancy Act, 1885, which is a scheduled Act under Section-9 of the Bihar Land Tribunal Act, 2009.

The Court considers that this matter can well be adjudicated by the Bihar Land Tribunal.

Accordingly, in terms of proviso to Section 15 of the Bihar Land Tribunal Act, the Registry is directed to transmit the record of the case to the Bihar Land Tribunal forthwith. (Rakesh Kumar, J) NKS/- U
