The petitioner is apprehending his arrest in a complaint case wherein processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 468, 471, 406, 323 and 504/34 of the Indian Penal Code.

No.53292 of 2015 (2) dt.23-11-2015 2/3 fifty thousands rupees were taken from the complainant and three lakhs rupees from one Gyasuddin for getting recruited as Constable in CRPF. It is alleged that Avinash Singh, Baban Singh and this petitioner came and offered the complainant to get recruited as Constable in C.R.P.F.

It is submitted by learned counsel for the petitioner that it is not clear either from the complaint petition or the S.A. of the complainant that she gave any money to the petitioner. Since the petitioner has been selected in S.S.B. and complainant though qualified at the physical test but could not be finally selected hence, due to rivalry the complainant has filed the present false complaint. There is no proof on the record that any payment was made to the petitioner.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Saran at Chapra in connection with
