The present writ petition has been filed seeking following relief(s):- "(i) For commanding the Respondents (Nos. 23), to check the nefarious and criminal activities of the private respondent No. 4 - Rajkumar Prasad Swarnkar, as he along with his henchmen are creating serious, illegal and arbitrary obstructions for the petitioners in

Patna High Court CR. WJC No.666 of 2025(3) dt.24-11-2025 2/3 relation to construction of their house, and the present situation is such that they are fearing for the safety and security of their lives and family members.

(ii) For seeking explanation particularly from the Respondent No. 3, as to why he has provided all the leeway and tactical support to the private respondent while he has executed his plans and activities with finesse.

(iii) For also issuing complete and comprehensive guidelines to the respondents for maintaining peace and security.

(iv) For any other reliefs which the Hon'be High Courts thinks proper and just in the facts and circumstances of this case.

3. From perusal of record and counter affidavit, I find that the disputed questions of fact are involved in the present writ petition. Therefore, the present petition could not be entertained by this Court since complex of title and possession are beyond the purview of the writ jurisdiction of this Court and hence, the present petition is disposed of with a direction to the parties to take recourse of law in appropriate proceeding before appropriate forum.

4. Meanwhile, the State-respondents are directed to maintain peace between the parties.
