The petitioner has preferred this application for grant of regular bail in a case registered under section 420, 406, 467, 468 and 34 of the Indian Penal Code.
As per the prosecution case, it is stated by the informant that the petitioner who was working in his petrol pump for the last many years since 2018, it transpired that he had bungled the accounts of the petrol pump and defalcated a sum of over Rs.1 crore.
It is submitted by learned Senior counsel appearing for the petitioner that the petitioner has been falsely implicated in the case for reasons other than what has been narrated in the F.I.R. Even accepting the allegations as made in the F.I.R., the
Patna High Court CR. MISC. No.26424 of 2022(3) dt.16-01-2023 2/2 case is one of accounting and civil in nature. In any view of the matter, differences in accounting has been settled between the parties by paying a sum of Rs.16.2 lacs by the petitioner vide receipt as contained in Annexure-2. The petitioner is in custody since 23.3.2022 and chargesheet has been submitted in the case. Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the nature of allegation, the submission made by learned Senior counsel appearing for the petitioner, the document brought on record as Annexure-2 to the petition, the petitioner being in custody since 23.3.2022 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Industrial Area P.S. Case no.215 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur.
