Let the defect(s), if any, be removed within a period of four weeks from today.
The petitioner seeks bail in connection with (S.Tr. No. 494 of 2018) C.I.S. No. 494 of 2018 arising out of Akorhi Gola P.S. Case No. 84 of 2018 registered for the offence under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner has misused the privilege of bail and he his in custody since 09.01.2023.
Learned A.P.P. has vehemently opposed the prayer for bail.
Considering the period of custody, this application for regular bail is allowed.
Let the petitioner, above named, be released on bail after framing of charge, on furnishing bail bond of Rs.
Patna High Court CR. MISC. No.28708 of 2023(2) dt.24-05-2023 2/2 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Rohtas at Sasaram in connection with (S.Tr. No. 494) of 2018 C.I.S. No. 494 of 2018 arising out of Akorhi Gola P.S. Case No. 84 of 2018.
The petitioner would cooperate in the proceeding of the court below. In the even of failure to appear on two consecutive dates, the court below will be at liberty to pass appropriate order including the cancellation of bail bonds of the petitioner.
In case, the other co-accused persons are not appearing in court then the court below will proceed for framing of charge, after separating the trial of the petitioner. (Sandeep Kumar, J) Guddu/- U T
