JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-08-2017 This application has been filed for modification of the order dated 05.07.2017 passed in Cr. Misc. No. 29418 of 2017 for extending the period of surrender.

It appears that this is the second time the petitioner has moved for extending the period of surrender before this Court as his prayer for extending the period of surrender was earlier rejected vide order dated 05.07.2017 in Cr. Misc. No. 29418 of 2017 with a direction to surrender within a period of three weeks from the date of order and pray for regular bail. However, the petitioner had not surrendered and another application for extension of period of surrender has been filed by him. This appears to be a very bad practice and amounts to violation of direction of this Court.

In such view of the matter, by way of last indulgence, further three weeks' time is allowed to the petitioner to surrender in the

Patna High Court Cr.Misc. No.36893 of 2017 (2) dt.09-08-2017 court below and pray for regular bail which shall be considered by the court below on the ground that earlier he has been granted privilege of anticipatory bail but he could not surrender within time due to some unavoidable circumstances, considering the fact he shall pass an appropriate order.

It is also made clear that no further application for extension shall be entertained.
