Petitioner prays for grant of anticipatory bail in Siwan (Mahila) P.S. Case No 198 of 2014 (G.R. No. 3712 of 2014) registered under Sections 364, 302, 201 and 34 of the Indian Penal Code.
The son of the complainant was married to the daughter of the petitioner. It is alleged that some of the accused persons came at the house and persuaded her son to go along with them on a plea of providing job. He was taken to Delhi and thereafter he was traceless. There is also an allegation that the complainant's son's wife had an illicit relation with her sister's husband which was being opposed by the son. This case was lodged in the year 2012. Investigation is still underway.
Patna High Court Cr.Misc. No.53974 of 2015 (3) dt.16-02-2016 2/2 Having regard to the seriousness of the allegation and the fact that evidence are yet to be collected in the case as also the relation of the petitioner with wife of the son of the complainant, I am not persuaded to extend the privilege of anticipatory bail. The prayer is rejected. Petitioner may surrender and seek bail which shall be considered on its own merit by the Court below.
