The petitioner seeks bail in anticipation of his arrest in connection with Khajauli P.S. Case No. 174/2012 dated 14.10.2012 instituted for the offences under Sections 147, 148, 149, 341, 323, 333, 337, 427, 452, 435, 436, 380, 504, 506 and 120(B) of the Indian Penal Code.
The petitioner is not named in the F.I.R. and his name only transpired during the course of investigation. It has been alleged that around 2000 persons had indulged in loot, arson, and vandalism when they learnt that the dead body of a person was recovered a day after he had eloped with a girl. Irked by the inefficiency of the police, the Block Office was gheraod and ransacked and public property was damaged.
Though, many persons are said to have assembled at
Patna High Court Cr.Misc. No.4248 of 2018 (2) dt.01-02-2018 2/2 the place of occurrence, but nothing specific has been alleged against anyone of them, much-less the petitioner. The petitioner does not claim to be part of any student body and completely denies the allegation levelled against him. The basis for implicating the petitioner in the present case also appears to be unknown. Considering the aforesaid facts, the petitioner above named is directed to be released on bail, in the event of his surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bond in the sum of Rs. 10,000/- (Ten Thousand), with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IIIrd, Madhubani in connection with Khajauli P.S. Case No. 174/2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
