However, the order impugned in the appeal itself has been passed under Section 24 of the Hindu Marriage Act, against which no appeal can be filed.

Mr.Bakshi S.R.P.Sinha, learned Senior Counsel appearing along with Mr. Ajay Nandan Sahay, Advocate-on-Record for the appellant seeks permission to convert the present appeal into an application under Article 227 of the Constitution of India. The prayer is allowed.
