Petitioners seek bail in Jamo Bazar P.S. Case No. 154 of 2018 registered under Sections 302 and 34 of the I.P.C. The accusation is that both the petitioners having axe in their hand reached near the neem tree of the informant, Panmati Kunwar and started to cut the same when Bacha Singh husband of the informant made protest both the petitioners thrashed him on the ground thereafter, petitioner no.1 Birendra Singh, pressed the chest of the husband of the informant with knee and leg, petitioner no.2 Ravindar Singh pressed the neck of the informant. When wife of the informant rushed to save him, she was also assaulted. On intervention of villagers her husband
Patna High Court CR. MISC. No.23264 of 2019(2) dt.11-04-2019 2/2 was taken to the hospital but he died in the way. Learned counsel for the petitioners submit that while there specific allegation has been made against Petitioner no. 1 to press the chest of the informant's husband through knee and leg and petitioner no. 2 to press the neck but no external and internal injury was in the P.M.report of husband of the informant. Further submission is that both the petitioners are in custody since 22.11.2018 and charge-sheet has been submitted against the petitioners.
Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount to the satisfaction A.C.J.M.-XIII, Siwan in Jamo Bazar P.S.
