The petitioner has filed the instant writ petition for the relief of regularization on Class IV post in the office of the respondent-Staff Selection Commission. He has also sought quashing of the order dated 05.10.2007 whereby private respondents were appointed by way of regularization.
Patna High Court CWJC No.5231 of 2009(11) dt.15-07-2019 3/3 Learned counsel for the State points out that pursuant to orders passed, on earlier writ petitions filed by the petitioner, the Chairman of the Bihar Staff Selection Commission has passed a reasoned order dated 05.06.2008 on the same claim of the petitioner (Annexure A to the counter affidavit filed on behalf of respondents 3 and 4). The same is the subject matter of the proceedings arising out CWJC No 11464 of 2012. Since all the issues now stand merged in CWJC No 11464 of 2012 and the same is pending consideration in the above noted subsequent proceedings, these writ proceedings need not be continued as all the claims raised herein can be considered in the subsequent writ proceedings. The instant writ petition is, therefore, disposed of with liberty that petitioner may raise all the issues in the subsequent writ proceedings arsing out of CWJC No 11464 of 2012.
