JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-04-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 30A,37(b)(c) of Bihar Prohibition of Excise Act Patna.

Police made raid on the basis of secret information to this effect that some persons were selling illicit liquor near Takashal Khandha and when police party reached there the petitioner and others started fleeing from there and at that time petitioner was carrying a bag in his head. However, petitioner was apprehended and 27 liters country made Mahua liquor kept in 135 Polythene bags were recovered from possession of the petitioner.

Patna High Court CR. MISC. No.24631 of 2019(2) dt.18-04-2019 2/2 Submission on behalf of the petitioner is that nothing was recovered from conscious possession of the petitioner and as a matter of fact, police seized illicit liquor near Takashal Khandha but implicated the petitioner because petitioner was found present there. It is further submitted that petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge Excise Civil Court, Patna in connection with Danlyawan P.S. Case No. 37 of 2019. (Hemant Kumar Srivastava, J) N.K/- U T
