The petitioner being the husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 498A, 323, 504/34 of the Indian Penal Code.

The basic accusation is of torture.

It is submitted by the learned counsel for the petitioner that petitioner admits his marriage with the informant, but the Matrimonial Suit 483 of 2014 was filed at earlier point of time.

On the joint prayer of the parties, the matter was referred to the Mediation Centre of the Bihar State Legal Services Authority vide order dated 15.01.2016. The report of the Mediator at Flag-'O' reflects that the issue

Patna High Court Cr.Misc. No.27746 of 2015 (8) dt.12-07-2016 has been settled and both sides decided to part ways on payment of permanent alimony of Rs.15,00,000/-to the informant Simmi Priya @ Jani and Rs. 5,00,000/- to the daughter of the informant Aradhya Singh.

It is submitted by the learned counsel for the petitioner that entire payment has been made. Learned counsel for the informant does not dispute the contention of the learned counsel for the petitioner.

Considering the present stand of the parties, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Kotwali P.S. Case No. 471 of 2014, subject to conditions as laid down under Section 438(2) of the Cr.P.C.

Let, a copy of the order and report of the Mediator along with agreement be transmitted before the learned court below.
