JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-11-2015 Earlier petitioner came before this court for grant of regular bail by filing Cr. Misc. No. 6680 of 2015 which was disposed off by a coordinate bench of this court vide order dated 26-02-2015 directing the trial court to release the petitioner after framing of charge but grievance of the petitioner is that uptill now, charge could not be framed as other accused are not being produced before the trial court from concerned jail and accordingly, it is prayed that the order dated 26-02-2015 passed in Cr. Misc. No. 6680 of 2015 be modified.

In my view, it is not a case of modification and, accordingly, petitioner is permitted to withdraw this petition with liberty to file fresh bail petition before this court.
