The petitioner apprehends her arrest in Goraul P.S. Case No. 51/2016, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code. The informant Chandeshwar Singh named the petitioner along with others. Petitioner is alleged to have assaulted the wife of the informant with lathi which hit on her arm. Learned counsel for the petitioner submits that petitioner is a lady. No injury was caused to the wife of the informant on account of assault by the petitioner. There is counter version being Goraul P.S. Case No. 72/2016.
Learned A.P.P. however, opposed the prayer for anticipatory bail of the petitioner.
Patna High Court Cr.Misc. No.41461 of 2016 (2) dt.19-11-2016 2/2 Considering the facts aforesaid and the fact that petitioner is alleged to have assaulted the wife of the informant and no apparent injury was caused to her, the petitioner abovenamed, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Goraul P.S. Case No. 51/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
