2. The petitioner has renewed his prayer for grant of regular bail in connection with Sonbarsa P.S. Case no.461 of 2022, registered under sections 8, 20(b)(ii)(C) and 22 of the N.D.P.S. Act.
3. As per the prosecution case, 105 Kgs of ganja like substance was recovered from the possession of the petitioner and one another.
4. Learned counsel for the petitioner submits that the prayer for bail of the petitioner was rejected on earlier occasions, the last being vide order dated 19.12.2025 passed in Cr. Misc. no.66821 of 2025 directing the learned Court below to expedite the trial and conclude the same within a period of three
Patna High Court CR. MISC. No.29915 of 2026(3) dt.03-07-2026 2/3 months. Inspite of more than six months having passed, the trial has still not concluded. It is submitted that co-accused Ranjan Kumar Patel has been enlarged on bail. The petitioner having remained in custody since 17.12.2022 and not having any criminal antecedent, he be enlarged on bail.
5. The application for bail is opposed by learned APP for the State.
6. A report was called for from the learned trial Court with respect to the stage of the trial. As per the report received contained in letter dated 7.5.2026 of the District & Additional Sessions Judge-II, Sitamarhi, all the prosecution witnesses have been examined and as on the date of the report i.e. 7.5.2026, the case of was pending for recording of statement under section 313 of the Cr.P.C. The report further states that the trial is near its conclusion and an extension of 1-2 months has been sought for.

Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner and one another of recovery of 105 Kgs of ganja like substance together with the trial having reached its conclusion, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.

8. Learned trial Court is directed to conclude the trial within a period of three months.
