Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Motihari Town P.S. Case No. 37 of 2023 registered for the offence under Sections 414 of the Indian Penal Code.

Prosecution case in short is that during the course of vehicle checking the petitioner started fleeing away after seeing the police but the police chased and apprehended the petitioner and upon that when the police asked the petitioner to show the documents of the motorcycle he was unable to produce any document regarding the motorcycle.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case only on the

Learned counsel for the petitioner also submits that the petitioner is in custody since 14.01.2023. Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the nature of offence and also considering the period of custody, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail after completion of six months in custody on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Motihari, East Champaran in connection with Motihari Town P.S. Case No. 37 of 2023.

The petitioner will visit Banjariya Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
