Petitioners apprehend their arrest in connection with Pandarak PS case no. 72 of 2016 registered for the offences punishable under Sections 307 and other sections of Indian Penal Code.

The allegation of the informant is that accused persons including the petitioners had apprehended the informant while he was coming on motorcycle and assaulted him with various weapons.

Learned counsel for the petitioners submit that the injuries are simple in nature as is apparent from the injury report. It is further submitted that petitioner nos. 3, 4 and 5 have no

No.32649 of 2017 (2) dt.13-07-2017 2/2 criminal antecedents and as far as petitioner nos. 1 and 2 are concerned, one case is pending against them which has been filed by the same informant but they have been granted bail in the said case. It is further submitted that on account of land dispute, the said case has falsely been filed against the petitioners especially on account of the fact that earlier, the petitioners had also filed a case against the informant of the present case. Having regard to the facts and circumstances of the case, I deem it fit and appropriate to grant anticipatory bail to the petitioner.

Accordingly, let the abovenamed petitioner, in the event of their arrest or surrender in the Court below within a period of four weeks from today, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate, Barh (Patna) in connection with Pandarak PS case no. 72 of 2016 subject to the conditions enumerated under Section 438(2) of Code of Criminal Procedure.
