This is an anticipatory bail for the offences under Sections 147, 149, 342 and 353 of the Indian Penal Code. It has been submitted by the learned counsel for the petitioners that petitioner no.1 is the Chairman of PACS and petitioner no.2 is the member of PACS. It has been further submitted that, as a matter of fact, petitioner no.2 has raised some objection with regard to irregularities and due to that the petitioners have falsely been implicated in this case. The F.I.R. has been lodged against the petitioners and 200 other persons. Heard learned A.P.P. appearing for the State, who could not controvert this fact.

No.49930 of 2016 (2) dt.19-12-2016 2/2 Having heard both sides and in view of the fact that petitioner no.2 has lodged complaint against Circle Officer, let, above named petitioners, in the event of their arrest/surrender in the court below within six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar at Buxar, in connection with Brahmpur P.S.Case No. 246 of 2016, subject to the conditions as laid down u/s 438(2) Cr.P.C. and further that the petitioners will cooperate in the investigation of the case as and when required by the police.
