In this case, the petitioner is apprehending his arrest in connection with Raghopur P.S. Case No. 20 of 2017 registered for offences under sections 147, 148, 149, 341, 447, 448, 323, 307, 379, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
An allegation has been made that the accused persons have gone to the plot of land of the Informant and forcibly tried to capture the land and started construction over the land. Learned counsel for the petitioner submits that the land belongs to the petitioner, he had gone there to construct the house over the same. Learned counsel for the petitioner further submits that the
Patna High Court Cr.Misc. No.33465 of 2017 (2) dt.24-07-2017 specific allegation is against co-accused Pramod Rai, Amod Rai and Subodh Rai who have resorted to firing. He further submits that the petitioner is a retired teacher and is aged about 63 years old.
Looking to the entire facts and circumstances of the case and the old age of the petitioner, let the petitioner, namely, Brahmdeo Rai, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Hajipur in connection with Raghopur P.S. Case No. 20 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Shivaji Pandey, J) Rishi/- U T
