====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 05-07-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner apprehends his arrest in a case registered for the offence punishable under Section 395 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is a person with clean antecedent. The informant alleges that unknown criminals intercepted him and looted Rs.5 lakhs in cash along with gold ornaments.
Learned counsel for the petitioner submits that FIR was against unknown and the petitioner came to be implicated based on CCTV footage and tower location of his mobile. It is further submitted that merely because tower location of the
Patna High Court CR. MISC. No.27370 of 2023(2) dt.05-07-2023 2/3 petitioner was at the place of occurrence and he was seen in the CCTV footage the police implicated him. It is next submitted that the occurrence took place near the house of the petitioner and, as such, he came out of his house to witness the occurrence. It is also submitted that petitioner will not abscond rather will cooperate in the investigation and will present himself as and when required by the investigating officer of the case for eliciting the truth.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bhagwan Bazar P.S. Case No. 430 of 2022, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. One of the bailors of the petitioner shall be his brother-in-law Purushottam Singh.

No.27370 of 2023(2) dt.05-07-2023 3/3 However, it is made clear that if the investigating officer of the case files an application bringing to the notice of the learned court below that petitioner despite giving assurance to this Court is not cooperating in the investigation or is not presenting himself when required by the investigating officer the learned court below shall be at liberty to cancel the bail bonds of the petitioner after recording reasons.
