Petitioner apprehends his arrest in connection with Sakurabad P.S.Case No. 17 of 2018 registered for the offences punishable under Sections 414 and 427 of the Indian Penal Code. Prosecution case is that police on information raided near the house of the petitioner and found that petitioner along with other accused was cutting the tempo in two pieces for bringing the same to another place and on seeing the police party he fled away. Submission of learned counsel for the petitioner is that he has falsely been implicated and nothing has been recovered from his possession.
Heard learned APP also, who has opposed the prayer for anticipatory bail of the petitioner.
Patna High Court Cr.Misc. No.23692 of 2018 (2) dt.20-04-2018 2/2 Having heard both sides and in the facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner, rather petitioner to surrender and pray for regular bail, which shall be considered on its own merit.
