JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-01-2017 Heard learned counsel for the petitioners as well as learned A.P.P. for the State.

This application is for grant of anticipatory bail in connection with Bettiah Town (Kalibag O.P.) P.S.Case No.377 of 2016 for the offence under Sections 147, 148, 149, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code.

It is submitted on behalf of the petitioners that there is a case and counter case between the parties and the injuries

Patna High Court Cr.Misc. No.54507 of 2016 (2) dt.12-01-2017 were found on both sides, which are simple in nature. Heard learned A.P.P. as well as the learned counsel for the informant. They could not controvert the fact that injuries are simple in nature and there is a case and counter case. Having heard both sides. In view of the facts as stated above, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Bettiah, District- West Champaran in connection with Bettiah Town (Kalibag O.P.) Police Station Case No.377 of 2016 , subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
