This application, for grant of anticipatory bail, arises out of Alamnagar P.S. Case No. 103 of 2016, disclosing offences under Sections 406, 409, 34 and 120(B) of the Indian Penal Code. It is alleged against the petitioners, who are the Chairman and Manager of Nathua Bhagipur PACS, in the district of Madhepura, that they misappropriated C.M.R. to the tune of 1431.39 quintals.

Learned counsel, appearing on behalf of the petitioners, has submitted that the total value of the said C.M.R., comes out to be Rs. Twently Lakh Forty Two Thousand Nine Hundred Forty

Patna High Court Cr.Misc. No.43085 of 2016 (2) dt.25-10-2016 2/2 Six (20,42,946/-) out of which, the petitioners have already deposited a sum of Rs. 5,35,495/- and for the remaining amount, which is about Fifteen Lakh (15,00,000/-), the petitioners are ready to deposit the same, within a period of four months from today.

Considering the submission, as above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Udakishunganj, Dist-Madhepura, in connection with Alamnagar P.S. Case No. 103 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
