JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 17-02-2018 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered for the offence punishable under Section 406 of the Indian Penal Code.

It is alleged against the petitioners that the informant sold his land for Rs. Nine lakhs as consideration amount and handed over the same to co-accused Mayaram Sah and Pankaj Sah, but subsequently they declined to return the said money.

It is submitted by learned counsel for the petitioners that the thrust of accusation is against co-accused Mayaram Sah and his son Pankaj Sah, who have been granted

Patna High Court Cr.Misc. No.9549 of 2018 (2) dt.17-02-2018 anticipatory bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 31227 of 2017.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Ballia P.S. Case No. 36 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
