ANJANA PRAKASH ORAL JUDGMENT Date: 24-11-2015 The petitioner seeks quashing of the order of none discharge dated 14.03.2011 by which the Sessions Judge, Patna in Cr. Revision no. 782 of 2010 has affirmed the order of cognizance dated 20.08.2010 passed by the Judicial Magistrate 1st Class, Patna in S.K.Puri P.S. Case No. 150 of 2009.
It has been submitted that the first information report was instituted by a private person which is not permissible under the Copy Rights Act. Further submission is that an information had been given to the police before entering the premises but the 'Sanha' was recorded after the search and seizure was effected around 12 P.M. This is against the provisions of Section 6 of Young Persons (Harmful Publication) Act.
Patna High Court Cr.Misc. No.14913 of 2011 dt.24-11-2015 2/2 Since these technical matters can be best determined only at the time of trial, I see no reason to interfere in the matter. Hence the application is dismissed. The trial Court is directed to expedite the trial without granting any unnecessary adjournment to any party.
