JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 25-01-2016 Petitioner, who happens to be the husband of the deceased, apprehends his arrest in a case instituted under sections 304B/34 of Indian Penal Code on the allegation that he along with others burnt to death informant's daughter, who had been married with the petitioner four years back. Learned counsel for the petitioner submits that informant's daughter caught fire accidentally, whereafter she was immediately taken to the SKMCH by him and other members of the family. The informant also rushed to the hospital, which fact would prima facie supports petitioner's case that her parents were duly informed of the accident. Learned counsel further submits that no person outside the family has supported the prosecution case.

Case of the petitioner may be appropriate for prayer for regular bail. The prayer for anticipatory bail is rejected.

The petitioner is directed to surrender

Patna High Court Cr.Misc. No.51588 of 2015 (3) dt.25-01-2016 2/2 and seek regular bail, which would be disposed of on its own merit with prejudice, preferably on the same day. Shashi.
