The petitioner being the Branch Manager of Idol India Group of Companies, Branch- Baheri, apprehends his arrest in Baheri P.S. Case No.181/16 for the offences under Sections 406, 467, 468, 469 and 120 (B) of the I.P.C.

Learned counsel for the petitioner submits that, admittedly, the petitioner was himself a functionary of the said Company and had been drawing the salary from the amount so collected by the informant from the consumers so deposited in the account of the said Company. It is further submitted that as the petitioner was informed that the aforesaid company is a registered Company and is affiliated with R.B.I. and

Patna High Court Cr.Misc. No.35742 of 2017 (2) dt.16-08-2017 2/2 runs under the guidance of SEBI, he joined as the Branch Manager of the aforesaid Company at Baheri Branch. As such, the petitioner is nowhere guilty of any allegation as has been made out by the informant who had himself first joined the said Company. Considering all the facts and circumstances of the case and amount in question having been deposited by the petitioner in the A/c of the Company and that the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the A.C.J.M.-VI, Darbhanga, in Baheri P.S. Case No.181/16 subject to the conditions as laid down under Section 438(2) of Cr.P.C. (Anjana Mishra, J) AnilKrSinha/- U T
