JUSTICE MIHIR KUMAR JHA ORAL ORDER 24-06-2015 Having regard to the admitted position that the petitioner is a workman in the Bihar State Road Transport Corporation and has been subjected to order of punishment of dismissal pursuant to a departmental proceeding, the remedy for him will be only before the competent Labour Court, as was held by this Court in the case of Sidheshwar Prasad vs. Bihar State Road Transport Corporation & Ors. reported in 2003 (2) PLJR 841.
When such an observation has been made, Mr.
V.R.P.Singh, learned counsel appearing on behalf of the petitioner
Patna High Court CWJC No.15672 of 2010 (3) dt.24-06-2015 2/2 seeks permission to withdraw this writ application in order to enable the petitioner to avail the remedy before the learned Labour Court.
