The petitioner apprehends his arrest in Dandkhora P.S. Case No. 48 of 2016 instituted for the offence under Sections 341, 323, 325 and 307 of the Indian Penal Code. It is alleged against the petitioner that he assaulted the husband of the informant and gave knife blow and also assaulted with fists, slaps, bricks etc., on account of which blood came out from his mouth and he became unconscious. He was taken to Katihar Sadar Hospital for treatment from where he was referred to Katihar Medical College and from there he was referred to PMCH, Patna. The injury report has been enclosed as Annexure-2 which shows that after C.T. Scan, injury no.1 was
Patna High Court Cr.Misc. No.600 of 2017 (3) dt.20-02-2017 2/2 found to be grievous.
In such circumstances, there is specific allegation of causing grievous injury to the informant against this petitioner. Therefore, this court is not inclined to grant petitioner anticipatory bail. Accordingly, this anticipatory bail petition is hereby rejected. The petitioner is directed to surrender before the court below within four weeks from today and seek regular bail which shall be disposed of in accordance with law preferably on the same day without being prejudiced by this order.
