The petitioners apprehend their arrest in a case under Section 307 and other sections of the Indian Penal Code. The informant alleged that petitioners and others brutally assaulted him and his wife.
It is submitted that there is a counter version being Jai Nagar P.S. case No. 129 of 2015 and from perusal of the injury report it would appear that the informant and his wife got simple injuries but from going through the injury report it appears that the informant got as many as 8 injuries out of which two injuries are caused by sharp edged weapons. Urmila Devi also got injuries. Considering the fact that the informant and his wife were indiscriminately assaulted and many injuries were caused by
Patna High Court Cr.Misc. No.51305 of 2015 (2) dt.15-12-2015 2/2 hard and blunt object as well as sharp edged weapon, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected.
If the petitioners surrenders in the court below, i.e., learned SDJM, Madhubani in Jay Nagar P.S. case No. 128 of 2015, within four weeks, the learned court below shall consider their prayer for regular bail without being prejudiced from the order of this court.
