Heard learned counsel for the parties.

This application for regular bail arises out of Nasriganj P.S. Case No. 174 of 2019, registered for the offence punishable under Section 392 of the Indian Penal Code. The petitioner's prayer for regular bail was earlier rejected by an order dated 12.10.2020 passed in Criminal Miscellaneous No.22227 of 2020 with a liberty to the petitioner to renew his prayer for bail after six months if there was no progress at the trial. The F.I.R. was registered against unknown persons with the allegation that two persons forcibly entered into the cash counter of the Bank and looted cash and mobile phone of the informant at the point of pistol. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.36151 of 2021(4) dt.08-09-2021 2/2 with reference to the supplementary affidavit filed in this case that in similar circumstance co-accused namely, Mantu Kumar and Ayush Kumar have been allowed regular bail by this Court vide order dated 28.07.2021 passed in Criminal Miscellaneous No. 13193 of 2021.

Considering the submission that similarly situated co-accused persons have been allowed regular bail by this Court, this application is allowed. Let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Additional Chief Judicial Magistrate-cum-Sub Judge-II, Vikramganj, Rohtas, in Nasriganj P.S. Case No.174 of 2019.

This is subject to the condition that the petitioner shall present himself before the Police / Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bond shall be liable to be cancelled.
