Petitioner seeks bail in Buxar (Town) P.S. Case No. 64 of 2019 registered under Sections 147, 148, 149, 302 of I.P.C. and Section 27 of the Arms Act.

The accusation is that eleven persons named in the F.I.R. having pistols in their hand surrounded son of the informant, namely, Amarjeet Yadav near Samudayik Bhawan in village Mathiya Morh and started indiscriminate firing in which son of the informant fell down. On raising alarm the villagers rushed there and when the informant reached near the son he died.

Learned counsel for the petitioner submits that petitioner has been falsely been implicated in this case. His

No.23307 of 2019(2) dt.11-04-2019 2/2 name has surfaced in course of investigation in confessional statement of co-accused Rakesh Yadav and except that nothing has been collected by the I.O. during course of investigation. The petitioner having no criminal antecedent is in custody since 02.02.2019.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount to the satisfaction of C.J.M., Buxar, in Buxar (Town) P.S. Case No. 64 of 2019.
