JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 26-11-2015 Heard learned counsel for the petitioner and the State. The petitioner held license for PDS shop. On remand of the matter from the Appellate Authority, the license of the petitioner has again been cancelled by the S.D.O., Patna City vide order dated 30.3.2013, contained in memo no.200 dated 2.4.2013(Annexure-1).

The petitioner submits that after remand of the matter, the licensing authority called for a report from which it would appear that he supplied the trade articles not regularly. In my view, the petitioner should take all points before the Appellate Authority. This writ application is disposed of with liberty to the petitioner to seek remedy of appeal. In case if any

Patna High Court CWJC No.17731 of 2013 (4) dt.26-11-2015 appeal is filed, the delay in filing of the same would be condoned as the petitioner was pursuing his remedy before this Court.
