JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-07-2021 Heard Mr. Umesh Kumar Singh, the learned counsel for the petitioners and the learned APP for the State. The petitioners seek bail in connection with Salimpur P.S. Case No. 81/2020 instituted for the offences under Sections 302/34 of the Indian Penal Code. The petitioners are the parents in law of the deceased and are aged persons. Petitioner no. 1 is 84 years of age whereas petitioner no. 2 is 65 years old. It has been submitted on behalf of the petitioners that the deceased and her husband were residing separately from the petitioners since 2008 and, therefore, the charges

Patna High Court CR. MISC. No.32117 of 2021(3) dt.23-07-2021 2/2 in the F.I.R. cannot be saddled on the petitioners. In fact, all the three sons of the petitioners including the husband of the deceased have been living separately for a long time. The petitioners have no idea as to the cause of death of the deceased. The viscera of the deceased has been sent for forensic examination to decipher the cause of death. The petitioners are in custody since 01.03.2021. Regard being had to the afore-stated facts, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Barh, Patna, in connection with Salimpur P.S. Case No. 81/2020 .
