NILU AGRAWAL ORAL ORDER 18-12-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner apprehends his arrest in connection with Bihta P.S. Case No. 704 of 2015 registered for the offence punishable under Sections 376/ 511 of the Indian Penal Code as well as Section 3(i)(x) (xi) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

The allegation against the petitioner is that he tried to commit rape on the informant, who works as a labourer in the brick-kiln of Ravi Raj Kumar, finding that the husband of the petitioner was away.

It has been submitted by the learned counsel for the petitioner that now a compromise has been entered between both

In such circumstances, let the petitioner, named above, in the event of his arrest or surrender before the Court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- ( Rs. Ten thousand only) with two sureties of like amount each to the satisfaction of learned A.C.J.M., Danapur, Patna in connection with Bihta P.S. Case No. 704 of 2015, subject to the conditions as laid down under Section 438 (2) of the Cr. P.C.

However, it is made clear that the petitioner, who is an accused in one another case, bearing Maner P.S. Case No. 451 of 2013 registered for the offence under Sections 323 and 354 of the Indian Penal Code, if the petitioner in future is found to have committed similar nature of offence, the learned court below will be at liberty to cancel his bail bond without being prejudiced by this order.
