The petitioner seeks regular bail in connection with Piprasi P.S. Case No. 06 of 2021 instituted for the offences under Sections 341, 323, 307, 504 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 04.02.2021, charge-sheet has been submitted in the case and is a person with clean antecedent. Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that the informant alleges that this petitioner came to his house and started abusing and on protest he assaulted with lathi causing injury to the informant on his head for which he

Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that the petitioner and informant are neighbours and on some altercation, the occurrence took place, the blow was not repeated and the nature of injury as contained in Annexure 2, is simple.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 04.02.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of Shri P. K. Sharma, learned Judicial Magistrate, 1st Class, Bagaha, West Champaran in connection with Piprasi P.S. Case No. 06 of 2021 subject to the condition as laid down under Section 437 (3) Cr.P.C.
