JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 304(B), 201 and 34 of the Indian Penal Code.
It has been submitted on behalf of the petitioners that petitioners are Nandosi and living separately from the family members of the deceased and except this there is nothing against the petitioners.
Learned Additional Public Prosecutor could not controvert the aforesaid fact.
Having heard both sides, in view of the fact that the
Patna High Court Cr.Misc. No.55146 of 2016 (2) dt.13-01-2017 2/2 petitioners are not related with the family of the deceased and they are living separately, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali, in connection with Rajapakar P.S. Case No. 29/2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with further condition that they will co-operate in the investigation of the case.
