The petitioner apprehends his arrest in Balthar P.S. case No. 72 of 2016 for the offences punishable under Section 363, 365, 366/34 of the Indian Penal Code.

The informant alleged that his daughter went to the house of Shiv Shanker Mahto but she did not return. The informant came to know that Ritesh Kumar, relative of Shiv Shanker Mahto, took her daughter to village Banhoura for the purpose of marriage.

The learned counsel for the petitioner submits that victim was in love with Ritesh Kumar. Ritesh Kumar has already been granted anticipatory bail vide order passed in Cr. Misc. No.

Patna High Court Cr.Misc. No.18039 of 2018 (2) dt.06-04-2018 2/2 5389 of 2017. The petitioner is not named in the FIR. The name of petitioner figured in the case in the statement of victim recorded under Section 164 of the Cr. P. C. The victim although disclosed the name of petitioner but she did not make any allegation of illtreatment at the hands of the petitioner. Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that Ritesh Kumar has already been granted anticipatory bail, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, West Champaran, Bettiah in connection with Balthar P.S. case No. 72 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
