JUSTICE AJAY KUMAR TRIPATHI ORAL ORDER 10-11-2015 Petitioner apprehends arrest in Turkaulia (Banjaria) P S Case No. 232 of 2015, registered under sections 363 and 366A of the Indian Penal Code.

Submission of the counsel for the petitioner is that 164 statement of the victim girl clearly indicates that out of her own volition she went with one Guddu Sah, got married to him in Nepal and they were living as husband and wife in Gopalganj from where police recovered and arrested. She has also expressed her desire to expend her life with Guddu Sah. Petitioner is said to be the brother-in-law of Guddu Sah. He is also alleged to have participated in the said occurrence.

The circumstances being such, let the petitioner Jhulan Sah, in the event of arrest and surrender before the court below within six weeks, be enlarged on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.52604 of 2015 (2) dt.10-11-2015 2 / 2 Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari, in Turkaulia (Banjaria) P S Case No.232 of 2015, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure and that one of the sureties will be a close blood relation of the petitioner and the other should be a person whose identity will be duly verified.
